Environmental Law No. 2872

Law No. 2872 on the Environment, enacted in 1983, aims to protect the environment, prevent pollution, and promote sustainable development. The law defines the environment as the biological, physical, social, and economic setting in which living beings interact. Key provisions include a ban on pollution, mandatory environmental impact assessments, waste management regulations, and the requirement for environmental permits. It outlines detailed procedures for the handling, transportation, recycling, and disposal of hazardous waste. Based on the “polluter pays” principle, the law mandates that those who damage the environment must bear the cost of remediation.

The law encourages individuals, institutions, and enterprises to act with environmental responsibility, requiring environmental management services to be conducted by licensed companies. It incorporates modern environmental strategies such as zero-waste systems, recycling, emission control, noise management, and protection of water resources. Environmental inspections and sanctions are enforced under the coordination of the Ministry, providing a strong legal framework. The law also mandates public education, awareness campaigns, and strategic environmental planning. Activities that harm the environment may be suspended, and resumption is conditional upon compliance with environmental regulations. Overall, this law establishes a robust legislative foundation to ensure a sustainable environment and to safeguard ecological integrity for future generations.
