Penalties Under Climate Law No. 7552

The Climate Law No. 7552, which came into force in 2025, introduces strict penalties to ensure effective climate change mitigation and compliance with greenhouse gas (GHG) emission targets. Companies operating within Türkiye must be aware of these financial and administrative sanctions to avoid significant legal and financial consequences.

One of the key obligations is the timely submission of verified GHG emission reports. Failure to comply results in administrative fines ranging from 500,000 TL to 5,000,000 TL. For businesses under the Emissions Trading System (ETS) scope, these penalties are doubled, reaching up to 10,000,000 TL.

The law also imposes severe penalties on those dealing with ozone-depleting substances. Using, importing, trading, or placing these substances on the market can lead to a 2,500,000 TL fine. Providing maintenance or services for equipment containing such substances results in a 250,000 TL fine, while non-compliance with labeling requirements brings a 120,000 TL penalty.

For fluorinated greenhouse gases, penalties include a 2,500,000 TL fine and the suspension of the Hydrofluorocarbon Control Certificate for up to six months. Importing these gases beyond allocated quotas leads to a 1,000,000 TL fine, alongside quota reductions.

Failure to submit notifications or updates to official databases, intervening with related equipment, or operating without the necessary emissions permits can result in fines ranging from 120,000 TL to 10,000,000 TL, depending on the severity of the violation. Additionally, ETS participants who fail to deliver their required allowances may face penalties calculated at double the market allowance price.

Repeated offenses within three years trigger increased penalties, with fines doubled for second or subsequent violations. The law also allows authorities to suspend operations until compliance is achieved. Maximum administrative fines per offense can reach 50,000,000 TL.
