Pharmaceutical destruction and drug raw material disposal

Pharmaceutical destruction: we dispose of expired, cold-chain-compromised, quality-defective or recalled medicines and drug raw material with licensed vehicles and facilities, fully documented and traceable. Every step is recorded with official minutes, photos and video records, and we also protect your brand from counterfeit and grey-market risk.

Overview

Pharmaceutical disposal is no ordinary waste job

In the pharmaceutical sector, waste disposal is one of the most sensitive processes due to patient & brand safety, misuse risk, and strict regulation. Careless disposal of expired, cold-chain-compromised, quality-defective, or recalled products creates both legal liability and brand reputation risk. Scrap carries out this process with licensed vehicles & facilities, in a recorded, controlled, and documented manner.

Properly structured waste disposal reduces the tax base through a written-off goods record, eliminates the risk of counterfeit and grey-market circulation, and protects companies during GMP and audit processes. Every stage, from request to official record, is traceable through the Online Tracking System.

Pharmaceutical destruction guide: what it is, how it works, what you gain

What is pharmaceutical destruction?

Pharmaceutical destruction is the controlled removal of expired, cold-chain-compromised, quality-defective or recalled medicines and drug raw material stock. We run pharmaceutical destruction with licensed vehicles and facilities, and we document every step from collection to the destruction minutes.

Careless disposal of medicines, however, creates legal liability and reputation risk. First, the product can leak into counterfeit and grey markets. Second, without documented destruction you cannot defend the tax treatment of the written-off stock. We explain how this risk arises in our article on uncontrolled disposal, and you can read about the counterfeit side in our article on counterfeit drug scandals.

Which pharmaceutical products are destroyed?

The groups we meet most often are:

  • Expired medicines: human and veterinary products past their expiry date.
  • Products with a broken cold chain: vaccines, biologicals and heat-sensitive products.
  • Production waste and rejects: out-of-specification semi-finished goods, defective batches and production residue.
  • Products collected from the market: batches gathered under a recall decision.
  • Samples and promotional products: medical promotional samples.
  • Packaging, leaflets and raw material: branded packaging, leaflets, and active ingredient and raw material stock.

Pharmaceutical destruction methods

We choose the method by product type and risk. First, we make the product unusable; then we route recoverable material to recycling.

Method When it applies Outcome
Controlled incineration Medicine batches that we find suitable for incineration by type The product becomes unusable at a licensed facility
Chemical decomposition Products and raw materials that require chemical treatment The product is processed at a licensed facility and cannot return to the market
Biological methods Batches whose type suits biological treatment The product is disposed of at a licensed facility
Sorting and recycling Recoverable material such as branded packaging and leaflets The material enters a recycling stream; branded packaging cannot be reused

Every item appears separately in the destruction minutes.

Legal basis of pharmaceutical destruction

Pharmaceutical destruction touches three areas of legislation at once: recall, environment and tax. We therefore build the process around all three.

  • Recall: the Regulation on the Withdrawal of Human Medicinal Products and Foods for Special Medical Purposes sets the rules for products that turn out defective or are suspected of being so. After the provincial or district health directorate completes its verification, the license holder either returns the product to its source or has it destroyed in line with the legislation.
  • Environment: the Waste Management Regulation requires waste to be collected separately, recorded and sent to a permitted or environmentally licensed facility. Temporary storage lasts at most 6 months for hazardous waste and at most 1 year for non-hazardous waste. For this reason we destroy only at facilities licensed by the Ministry of Environment, Urbanization and Climate Change, and transport runs in sealed vehicles.
  • Tax: Article 278 of the Tax Procedure Law provides that the value of goods whose worth has fallen significantly is set by the Valuation Commission; Article 278/A opens a separate route for goods that must be destroyed for reasons such as expiry. The commission’s assessment and the destruction minutes are therefore the basis for expensing the stock cost.
  • VAT: Article 30/c of the VAT Law governs VAT on lost goods. For destroyed goods, the tax office and the Council of State hold different views; choose the route with your accountant once the documents are in hand. Details: VAT on destroyed goods.

Destruction minutes and reporting

The destruction minutes are the official record of which product we destroyed, in what quantity, on what date and by which method. At Scrap the minutes do not come alone; they are part of a document set:

  • the Valuation Commission’s assessment and a copy of its decision,
  • the licensed facility’s destruction and recovery records,
  • photo and video records of every batch,
  • steps you follow throughout on the Online Tracking System,
  • GMP audit-ready documents and the Sustainable Transformation Report: recovery and carbon data that feed directly into your ESG reporting.

This set answers the question “was the product really destroyed?” with a single file, both in a tax audit and in brand compliance reviews. We explain why your brand needs protection during destruction in this article.

Medicine recall versus pharmaceutical destruction

A medicine recall is a decision about a product that turned out defective or is suspected of being so. The regulation defines three classes by health risk: class one means a serious or life-threatening risk, class two a temporary or treatable effect, and class three a defect with no health risk. After the announcement, the license holder takes measures to bring the faulty product under control within 24 hours for class one, 48 hours for class two and 72 hours for class three.

An expired product, by contrast, is not defective; it has simply completed its shelf life. Once expired stock becomes waste, the Waste Management Regulation applies. However, if the same batch also raises a quality suspicion, the recall process runs as well. So have your license holder and the provincial health directorate confirm which route applies. On the financial side, we summarize the benefits of official destruction in our article on official disposal.

How pharmaceutical destruction works with Scrap

The process starts with the request form; we first analyze the product list, expiry dates, quantity and risk profile, then present a proposal. We handle the official applications and inspection appointments. Next, we move the medicines in sealed, ADR-certified vehicles to a licensed facility, where we dispose of or recycle them by type. Typical duration is about 21 business days. At the end you receive the minutes, GMP audit-ready documents, photo and video records and the Sustainable Transformation Report; for every pharmaceutical destruction project a tree is planted and a child joins a nature education programme.

Frequently Asked Questions

Common questions about pharmaceutical destruction

The questions we hear most often about the pharmaceutical destruction process, timing, documents and tax.

What is pharmaceutical destruction?

The controlled removal of expired, cold-chain-compromised, quality-defective or recalled medicines and drug raw material stock at a licensed facility, documented with official minutes.

Which pharmaceutical products are destroyed?

Expired human and veterinary products, products with a broken cold chain, production waste and rejects, products collected from the market, medical samples and promotional products, and branded packaging, leaflets and active ingredient stock.

How long does pharmaceutical destruction take?

From request to minutes, typical duration is about 21 business days. Official applications and inspection appointments set the pace; quantity and location can change it.

Does pharmaceutical destruction provide a tax benefit?

Yes. Stock whose value is set to zero by the Valuation Commission and documented with destruction minutes is expensed under Article 278 of the Tax Procedure Law and reduces the tax base. On VAT, the tax office and the Council of State differ; decide with your accountant.

Is a medicine recall the same as destroying expired medicine?

No. A recall is a decision about a product that turned out defective or is suspected of being so; an expired product is not defective but has completed its shelf life. Have your license holder and the provincial health directorate confirm which route applies.

Can I destroy a recalled medicine on my own decision?

First the provincial or district health directorate completes its verification. Then the license holder returns the product to its source or has it destroyed in line with the legislation. So we recommend not destroying anything before verification ends.

Can medicines go into household waste?

No. They create environmental and health risk, and the product can leak into counterfeit and grey markets. The Waste Management Regulation requires waste to be collected separately and sent to a licensed facility.

How do you stop medicines from leaking into counterfeit and grey markets?

We move products in sealed, ADR-certified vehicles to a licensed facility, make them unusable, and record every batch on photo and video, so a destroyed product cannot return to the market.

Can I follow the process?

Yes. You track the process in real time on the Online Tracking System; at the end you receive the official minutes, GMP audit-ready documents, photo and video records and the Sustainable Transformation Report.

How is the price of pharmaceutical destruction set?

Product type, quantity, location, transport and the chosen method set the price. We prepare a proposal after the analysis; just fill in the request form.
